Regulations

El Ingenio Shopping Centre has been classed as a PET FRIENDLY space since 17 June 2022. Pets are allowed inside the Shopping Centre and its communal areas (the term ‘pets’ refers solely and exclusively to domesticated dogs not classified as a potentially dangerous breed).

By the entrances to the Shopping Centre, there is an icon that indicates this new PET FRIENDLY protocol with a QR code you can scan to read up on all the regulations that apply to bringing your pets here. These regulations can also be found on the Shopping Centre’s website, www.elingenio.es. In addition to the rules described in these regulations, which are detailed below, the Municipal Ordinance of Velez-Malaga on pet ownership and potentially dangerous dogs must always be adhered to (BOPMA 21 March 2022). As for taking your pet into individual shops and establishments, each retailer reserves the right to allow pets or not (each one may have its own internal rules about the presence and behaviour of pets inside their premises). To find out if a specific retailer in El Ingenio is PET FRIENDLY or not, read these regulations (Annex 1) or check with the retailer itself. Optionally, establishments may have a badge indicating if they are PET FRIENDLY, if they are not PET FRIENDLY (meaning you may not enter with your pet) or if they allow pets but only on their terraces (bars and restaurants).

Regulations governing the presence of Pets within El Ingenio Shopping Centre

The purpose of these regulations is to set out the conditions whereby pets may be brought into El Ingenio Shopping Centre, as well as the obligations and responsibilities of their owners or companions.

Local, regional and state regulations governing animal ownership must be complied with at all times.

Pets – understood solely and exclusively as domesticated dogs – may be brought into the shopping area of El Ingenio provided that the owners or companions of the animals comply with the following regulations:

a) Any person who accesses El Ingenio Shopping Centre with a pet must accept the entry policy / regulation established in this document;

b) All service dogs may be brought into the Centre, duly identified in the shopping area and restaurants. Service dogs are dogs that have been individually trained to perform tasks to assist a person with disabilities or special needs (e.g., blind or visually impaired). All these dogs must always be fitted with a lead or harness.

c) Guide dogs: Guide dogs accompanying blind or visually impaired people will be allowed to access the Centre (they must wear a lead or harness).

d) Guide dogs in training: Guide dogs in training will be allowed to access the Centre (wearing a lead or harness) accompanied by their trainers). When accessing our facilities, the trainee guide dog must wear the distinctive vest that shows they are in training, and the person responsible for them must carry an ID card that certifies them as a Fundación ONCE trainer or instructor.

e) The pet must always be accompanied by a person 18 years or older (an adult). No one may bring/walk more than one pet.

f) The pet must always be on a lead or harness and must walk with its owner. The lead, whether extendible or not, should not exceed 50 centimetres in length. Under no circumstances may the pet walk around the Shopping Centre without a collar, lead or harness.

g) The pet must not be allowed to go on any furniture in the Shopping Centre.

h) Pets are not allowed in the toilets or breastfeeding rooms at the Shopping Centre.

i) It is strictly prohibited to bring dogs classified as potentially dangerous breeds under Law 50/1999, of 23 December, on the Ownership of Potentially Dangerous Animals, developed in Royal Decree 287/2002, to request a permit to own potentially dangerous dogs. These breeds are:

▪ Pit Bull Terrier
▪ Staffordshire Bull Terrier
▪ American Staffordshire Terrier
▪ Rottweiler
▪ Dogo Argentino
▪ Fila Brasileño
▪ Tosa Inu
▪ Akita Inu

Likewise, dogs affected by all or some of the characteristics indicated in Annex II of the aforementioned Royal Decree will also be prohibited from entering, specifically:

▪ Dóberman
▪ Bullmastiff
▪ Dogo de Burdeos
▪ Mastín napolitano
▪ Bóxer
▪ Presa canario o Dogo canario
▪ Bull Terrier
▪ Dogo del Tibet

The provisions relating to Royal Decree 1021/2022, of 13 December, which regulates certain requirements concerning hygiene in the production and sale of foodstuffs in retail establishments shall also apply; Law 11/2003, of 24 November, on the Protection of Animals, Decree 92/2005, of 29 March, which regulates the identification and registration of certain pets in the region of Andalusia; finally, Decree 42/2008, of 12 February, which regulates the possession of potentially dangerous animals in the region of Andalusia.

Crosses or hybrids of these breeds, as well as any dogs trained to attack or fight, will also be considered potentially dangerous. Annex 2 provides photographs of these breeds, so that they are easily identifiable. The staff at El Ingenio will alert the local police, if necessary, to enforce compliance with the relevant regulations. In the event that the local police are unable to attend, and the incident is considered serious, the national police or civil guard may be alerted.

j) The owner or person responsible for the pet must refrain from entering the Shopping Centre with the animal during its estrous cycle (when it is in heat).

k) Pets must be over 12 weeks of age to enter.

l) Sick, visibly weakened and unclean pets cannot enter the Centre.

m) The owner or person responsible for the pet must carry proof that the animal is up to date with its vaccines and deworming protocols; this proof may be required at any time by staff of the Shopping Centre. In addition, the pet must be microchipped in line with current regulations on the identification of domestic animals.

n) The pet must be trained and well behaved (avoid going with pets that bark frequently at strangers, which are not toilet trained, etc).

o) For the safety of the pets, it is forbidden for them to use escalators. Instead, the lifts can be used as long as the maximum capacity requirements are adhered to and they do not cause discomfort to other customers (if there are other people inside, you should ask if they are comfortable taking the lift alongside your pet and, if they are uncomfortable, wait and take the next lift).

p) You are not allowed to leave pets unattended, alone by the gallery or tied up by the entrances or communal areas inside or outside the Centre, or by the entrance to the various establishments.

q) The owner/person responsible for the pet must not allow the animal to go to the toilet on the premises of the Shopping Centre (either indoors or outdoors). If this does occur, the owner must have all the required cleaning equipment (bags, wipes, etc.) and will be responsible for removing the excrement. Should the owner neglect this responsibility, the Centre security staff will ask them to do it. If the owner does not have equipment to clean up after their dog, the security / cleaning staff will provide it, and it can also be requested at the information point of El Ingenio. If the pet urinates, the owner is responsible for notifying the cleaning or security department, so that a member of the cleaning staff can be dispatched to the area as soon as possible.

r) Each owner is solely responsible for their pet and ensuring it is properly looked after. By entering the premises of El Ingenio with their pet, the owner exempts El Ingenio Shopping Center from any liability regarding property or non-property damage that the pet may cause to third parties. The owner or person responsible for the pet will be liable for any damage caused by their pet within El Ingenio premises or those of third parties. This person must ensure that the animal does not cause discomfort or damage, in addition to ensuring the integrity of the animal itself.

s) The owner accepts any civil, administrative or criminal liability arising from any act performed by their pet, through their possession thereof, or for the breach of rules on animal ownership, holding El Ingenio harmless for any claim or conviction that is presented as a result of these facts, and will reimburse all expenses or costs that the latter incurs.

t) El Ingenio, through its security personnel, reserves the right to refuse entry to any pet whose behaviour affects the normal operation of the Centre, the well-being and safety of visitors, retailers, other collaborators and other pets. Likewise, El Ingenio has the right to ask the owner or person responsible for any pet to leave the premises if the pet disturbs or threatens the safety and well-being of other people or animals, either through their behaviour or for noise or hygiene reasons.

u) In order to guarantee the integrity and safety of its visitors, protect public health and avoid situations that may create danger, crowding or discomfort, both for people and animals, the Shopping Centre reserves the right to admit pets at specific times only. Security personnel may limit access to pets for reasons that pose a risk to visitors or to the animals themselves or during a specific event if so required.

v) El Ingenio reserves the right to modify or add additional clauses to these regulations at any time, in accordance with the policies and protocols that are considered most appropriate for the safety and health of visitors, as well as with the policies and protocols applied to pets.
